COMMONWEALTH OF MASSACHUSETTS The Trial Court Probate and Family Court Department Berkshire Division Docket No. BE26E0011 TO: James K. Fish, Jr., Benjamin Fish, Billie-Jean Fish, Melissa Fish, Mary Vymislicky, Traci Suraci and Richard Stucklen, and all other persons interested; A Petition for Partition, dated June 17, 2026 and filed June 24, 2026, has been presented to said Court by David E. Fish, Sr., Harvey E. Fish, Jr., Marcia E. Ethier and Christine Sawtelle of Washington and North Adams, Massachusetts, representing that they hold as tenants in common an undivided part or share in certain real estate situate in Washington, Berkshire County, Massachusetts, and described as follows: (Locus of real estate: 563 Washington Mountain Road, Washington, Massachusetts) Being the same premises conveyed to the Grantor herein by deed of James G. Stow and Maude S. Stow dated March 20, 1973, and recorded in the Berkshire Middle District Registry of Deeds in Book 934, Page 905. Saving and excepting therefrom the land conveyed to Christie, et ux by deed recorded in said Registry in Book 789, Page 281&c. Saving and excepting therefrom the land conveyed to John S. Kebabian by deed dated November 29, 1965, and recorded in said registry in Book 810, Page 277 (see corrective deed dated December 23, 1965, and recorded in said registry in Book 811, Page 334). Being the same premises shown on the sketch attached to the Deed from James G. Stow to Harvey E. Fish and Eulalia L. Fish dated June 26, 1974 and recorded in the Berkshire Middle District Registry of Deeds in Book 951, page 711, together with the spring and water rights reserved in the deed to Christie, at ux above referred to. Also excepting all the premises conveyed to Harvey E. Fish, Jr. and Marilyn Fish from Harvey E. Fish and Eulalia L. Fish by deed dated July 16, 1974 and recorded on July 16, 1974 in the Berkshire Middle District Registry of Deeds in Book 952, Page 90. Also excepting all the premises conveyed to David Fish from Eulalia L. Fish by deed dated November 6, 2003 and recorded on November 7, 2003 in the Berkshire Middle District Registry of Deeds in Book 2773, Page 250. And setting forth that the petitioners wish to hold said real estate in severalty; and further that the petitioners desire that all of said land may be sold at private sale for not less than $200,000.00 and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition of all, or any part of said land which the Court finds cannot be advantageously divided at private sale or public auction; and be ordered to distribute the net proceeds thereof in such manner as to make the partition just and equal. And further, petitioners seek a set off for any and all sale proceeds for all of the co-tenants' share of said costs and expenses that they have paid over the years. If you desire to object thereto, you or your attorney should file a written appearance in said Court at 44 Bank Row, Pittsfield, MA 01201, before ten o'clock in the forenoon on the 31st day of August, 2026, the return day of this citation.
