NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Rachel Laura Occhiogrosso-Schwartz to Mortgage Electronic Registration Systems, Inc., as nominee for Province Mortgage Associates, Inc., dated November 6, 2023 and recorded in the Berkshire County (Middle District) Registry of Deeds in Book 7520, Page 64, of which mortgage the undersigned is the present holder, by assignment from: Mortgage Electronic Registration Systems, Inc., as mortgage, as nominee for Province Mortgage Associates, Inc., its successors and assigns to U.S. Bank Trust Company, National Association, not in its individual capacity but solely as trustee of Grove Funding III Trust 2024-1, recorded on December 11, 2024, in Book No. 7745, at Page 150 for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 1:00 PM on July 1, 2026, on the mortgaged premises located at 109 Wendell Avenue and Learned Lane, Pittsfield, Berkshire County, Massachusetts, all and singular the premises described in said mortgage, TO WIT: The land with buildings thereon, situated in Pittsfield, Berkshire County, Massachusetts, bounded and described as follows: PARCEL I: A certain tract of land situated on the east side of Wendell Avenue in said Pittsfield, and bounded as follows: Beginning at the southwest corner of land formerly of John C. West & Bro.; thence running easterly on the south line of said West's land one hundred thirty-two (132) feet; thence southerly on a line parallel with the east line of Wendell Avenue eighty (80) feet; thence westerly on a line parallel with the north line one hundred thirty-two (132) feet to the east line of said Avenue; thence northerly on said Avenue eighty (80) feet to the place of beginning. PARCEL II: A certain parcel or strip of land bounded and described as follows: Beginning at a point in the easterly line of Wendell Avenue about eighty-one and six tenths (81.6) feet from the intersection of Wendell Avenue and Taconic Street; thence running easterly along the south line of the above-described parcel about one hundred thirty-six and eight tenths (136.8) feet to land now or formerly of William and Edward Cullen; thence southerly along said Cullen land three (3) feet; thence running westerly in a line parallel with said southerly line about one hundred thirty-six and eight tenths (136.8) feet to Wendell Avenue; thence running northerly along line of said Wendell Avenue three (3) feet to the place of beginning. PARCEL III. A certain piece or parcel of land situated in said Pittsfield and bounded and described as follows: Beginning at a point at the southeasterly corner of land conveyed by James E. Linnehan to Addison W. Gabeler by deed dated May 18, 1898, and recorded in Berkshire Middle District Registry of Deeds in said Pittsfield, in Book 304, Page 224; thence easterly along a line being the southerly line of said Gabeler land produced easterly to a point which is at the intersection of said southerly line of Gabeler land produced easterly and the westerly line of land now or formerly of one Cullen produced northerly; thence South 22 west (being the course of the westerly line of said land now or formerly of Cullen as stated in a deed of Anna Brayton to James E. Linnehan recorded in said Registry in Book 227, Page 12) to the northwesterly corner of land now or formerly of Patrick Cullen; thence South 68 15' East forty-nine and one-half (49 1/2) feet along the northerly line of said Cullen's land to the westerly line of Learned's Lane, so called; thence northerly along the westerly line of said Learned's Lane about seventy-seven (77) feet to now or formerly a fence post at the southeasterly corner of land formerly of Levi A. Stevens; thence westerly along the southerly line of said Stevens land forty-nine and one-half (49 1/2) feet to now or formerly a post at his southwest corner; thence northerly along said Stevens' westerly line eight and six tenths (8.6) feet to a point; thence westerly along the southerly line of land formerly owned by J.W. West & Bro. fifteen and seven tenths (15.7) feet to the northeasterly corner of land conveyed as aforesaid to Addison W. Gabeler; thence southerly along said Gabeler's Easterly line eighty (80) feet to the place of beginning. PARCEL IV: Beginning at a bound at the northwest corner of land formerly of Patrick Cullen, which point is three (3) rods westerly of the westerly line of Learned Lane, so-called, and four (4) rods nineteen and one-half (19-1/2) links northerly, measuring along the westerly line of said land formerly of Patrick Cullen from the northerly line of Taconic Street; thence westerly ten (10) feet, more or less, to the southeasterly corner of a strip of land described in deed from Albert W. Shaw to Addison W. Gabeler et ux dated April 16, 1907 and recorded in Berkshire Middle District Registry of Deeds in Book 338, Page 603; thence northerly along the easterly line of said last mentioned parcel three (3) feet, more or less, to the southerly line of land of the said Gebelor's; thence easterly along the said southerly line of said Gabeler's ten (10) feet, more or less, to its intersection with said westerly line of land formerly of Patrick Cullen continued northerly; thence southerly along the said extension of said west line of land formerly of Patrick Cullen three (3) feet, more or less to the place of beginning. These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed.
