Commonwealth of Massachusetts The Trial Court Probate and Family Court Department Berkshire Division Docket No. BE26E0012 TO: Nicholas Moscatiello of Watervliet, New York and all other interested; A Petition for Partition, filed May 11 2026, has been presented to said Court by Jacob Sinopoli of Dalton, Massachusetts, representing that he holds as joint tenant an undivided part or share in certain real estate situate in Pittsfield, Berkshire County, Massachusetts and described as follows: (Locus: 315 Lenox Avenue, Pittsfield, MA) A parcel of land supposed to contain about 12,309 square feet, situated on Lenox Avenue, being Lot No. 11, Map 97, on file on the office of Board of Assessors, City Hall, Pittsfield, Massachusetts. Also being Lot No. 11 on plan of lots as surveyed and laid out by J.G. Dewey for William H. Demont, a copy of said plan is recorded in the Berkshire Middle District Registry of Deeds in Book 275, Page 606. Being the same premises conveyed to Grantor herein and Everett E. Harris by deed of D & T Builders, Inc. dated and recorded on November 10, 1976 in the Berkshire Middle District Registry of Deeds in Book 982, Page 141. The said Everett E. Harris having deceased on June 19, 2028. See death Certificate recorded in said Registry of Deeds immediately prior hereto. As per M.G.L. Chapter 188, sect. 13, Grantor, under oath and subject to the pains and penalties of perjury, does hereby depose, state and certify that: (i) i release all rights of Homestead in the subject realty, (ii) that no spouse, nonowner spouse, former spouse, or any other person resides in the home, and (iii) at the time of delivery of this deed, no spouse, former spouse, or any other person is entitled to claim the benefit of an existing estate of homestead. Real estate taxes for the fiscal year 2026 having been apportioned between the parties hereto as of the date hereof, the grantees herein assume and agree to pay the same. The common title to the property is derived under a deed from Martha R. Harris to Jacob Sinopoli and Nicholas Moscatiello dated November 21, 2025 and recorded with the Berkshire Middle Registry of Deeds in Book 7936, Page 19. Ad setting forth he desires that all of said land may be sold at private sale for not less than $259,000.00 and praying that partition may be made of all the land aforesaid according t law, and to that end that a commissioner be appointed t make such partition of all, or any part of said land which the Court finds cannot be advantageously divided at private sale or public auction; and be ordered to distribute the net proceeds thereof in such manner as to make the partition just and equal. And further that a set-off by made to Petitioner for compensation for his financial and equitable contributions. If you desire to object thereto, you or your attorney should file a written appearance in said Court at 44 Bank Row, Pittsfield, MA 01201, before ten o'clock in the forenoon on 28th day of August, 2026, the return day of this citation.
