MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE 23-25 Seymour Street, Pittsfield, Massachusetts 01201 By virtue and in execution of the Power of Sale contained in a certain mortgage (the "Mortgage") given by PETER G. DOBRANSKY and JUDY HUN to BERKSHIRE BANK, a Massachusetts banking corporation (the "Mortgagee") dated September 12, 2005, and recorded with the Berkshire Middle District Registry of Deeds in Book 3328, Page 26, of which the undersigned is the present holder by virtue of that certain Assignment of Mortgage from BERKSHIRE BANK to RUBY LENDING LLC, a Massachusetts limited liability corporation having a mailing address of 346 Race Street, Holyoke, Massachusetts 01040, dated June 30, 2025, and recorded with said Registry of Deeds in Book 7848, Page 149, for breach of the conditions of the Mortgage and for the purpose of foreclosing the same, there will be sold at Public Auction at 1:00 PM on the 27th day of August, 2026, at the mortgaged premises known as 23-25 Seymour Street, Pittsfield, Massachusetts 01201, all and singular, the premises described in the Mortgage (the "Mortgaged Premises"), to wit: "the following described property located in the County of BERKSHIRE: SEE EXHIBIT A ATTACHED HERETO AND MADE A PART HEREOF. which currently has the address of 23-25 SEYMOUR ST., PITTSFIELD, Massachusetts 01201: TOGETHER WITH all the improvements now or hereafter erected on the property, and all easements, appurtenances, and fixtures now or hereafter a part of the property." Exhibit A to the Mortgage reads as follows: "EXHIBIT "A" Beginning at a stone bound set at the southeast corner of land now or formerly belonging to William H. Carley; thence running Westerly along a line parallel with Madison Avenue, one hundred (100) feet to a stone bound; thence Southerly about thirty-five (35) feet to a stone bound; thence Easterly along the northerly line of a right of way, one hundred (100) feet to the westerly line of Seymour Street; thence Northerly along the westerly line of said Seymour Street about thirty-five (35) feet to the place of beginning, and land now or formerly of Carley. TOGETHER with the right to use the said right of way, in common with others. SUBJECT to a Taking by the Commonwealth of Massachusetts recorded in the Berkshire Middle District Registry of Deeds on January 12, 1999, in Book 1641, Page 1&c. Being the same premises conveyed to the mortgagors herein by deed of Michael J. Kelley and Susan M. Kelley recorded immediately prior hereto in the Berkshire Middle District Registry of Deeds." In the event of any typographical error set forth herein in the legal description of the Mortgaged Premises, the description as set forth and contained in the Mortgage shall control by reference. The Mortgaged Premises will be sold subject to and, with the benefit of, all restrictions, easements, improvements, leaseholds, tenancies, occupants, outstanding tax titles, municipal or other public taxes, liens, or other claims in the nature of liens, and existing encumbrances of record having priority over the Mortgage. The Mortgagee makes no representations concerning the condition of the Mortgaged Premises or its compliance with applicable zoning, building, sanitary or other state and/or municipal regulations.
