NOTICE OF ACTIVITY AND USE LIMITATION Town Highway Garage 14 East Street, Great Barrington, MA RELEASE TRACKING NUMBER 1-11160 A release of oil and/or hazardous materials has occurred at this location, which is a disposal site as defined by M.G.L. c. 21E, 2 and the Massachusetts Contingency Plan, 310 CMR 40.0000. On June 9, 2026, the Town of Great Barrington recorded with the Southern Berkshire Registry of Deeds a NOTICE OF ACTIVITY AND USE LIMITATION on the disposal site, pursuant to 310 CMR 40.1070 through 40.1080. The NOTICE OF ACTIVITY AND USE LIMITATION will limit the following site activities and uses on the above property: (i) Residential, school, playground, or day care use of the Property; and (ii) Non-emergency excavation and removal/relocation of petroleum-impacted soil or LNAPL encountered greater than eight (8) feet below grade, without prior development and implementation of a Health and Safety Plan. Additionally, a Soil and LNAPL Management Plan, prepared by a Licensed Site Professional, must be prepared in accordance with Obligations and Conditions (i) in Paragraph 3 as set forth below, and without completion of the activity in accordance with the Massachusetts Contingency Plan 310 CMR 40.0000.
