NOTICE OF ACTIVITY AND USE LIMITATION Former Rising Mill 295 Park Street, Great Barrington RTN 1-50095 A release of oil and/or hazardous materials has occurred at this location, which is a disposal site as defined by M.G.L. c. 21E, 2 and the Massachusetts Contingency Plan, 310 CMR 40.0000. On June 8, 2026, HPC Housatonic LLC recorded with the Southern Berkshire County Registry of Deeds a NOTICE OF ACTIVITY AND USE LIMITATION on the disposal site, pursuant to 310 CMR 40.1070 through 40.1080. The NOTICE OF ACTIVITY AND USE LIMITATION will limit the following site activities and uses on the above property: (i) Significant expansion or alteration of the "western building" within the Portion of the Property without consulting a Licensed Site Professional to perform an evaluation as to whether the Active Exposure Pathway Mitigation Measures ("AEPMMs") will continue to maintain a condition of No Significant Risk. The selected AEPMMs at the Portion of the Property are two sub-slab depressurization systems ("SSDSs") located at the first floor of the "western building" within the Portion of the Property; (ii) Construction of a new building within the Portion of the Property without evaluating the need for (1) the installation of a vapor barrier and an active or passive SSDS and (2) subsequent indoor air sampling to confirm the system's effectiveness in preventing vapor mitigation into the building; (iii) Modification, suspension, discontinuation, or removal of the SSDSs within the "western building" within the Portion of the Property without a Licensed Site Professional rendering an Opinion that a condition of No Significant Risk exists without the SSDSs' continuous operation; (iv) Activities and uses at the Portion of the Property that may damage the existing foundation or SSDSs within the "western building" within the Portion of the Property without subsequent repair within 30 days, in accordance with the Obligations and Conditions stated below and subsequent system testing to confirm the effectiveness of the repair; and (v) Residential development or occupancy within the Portion of the Property.
