MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Himalayan High LLC in favor of Boston Trust Loans LLC dated March 6, 2023 and recorded on March 9, 2023 with the Berkshire (Middle District) County Registry of Deeds in Book 7383, Page 68, as assigned to Mutual One Bank, by assignment recorded with said Deeds on March 9, 2023, at Book 7383, Page 112, as assigned to Boston Trust Loans LLC by assignment recorded with said Deeds on April 10, 2026 at Book 8002, Page 295, as assigned to Boston Trust Lending LLC by assignment recorded with said Deeds on April 10, 2026 at Book 8002, Page 297 for breach of the conditions of said mortgage and for the purpose of foreclosing same will be sold at public auction at 12:00 pm on May 8, 2026 on or near the mortgage premises being known as 2727 Jacobs Ladder Road, Becket, Berkshire County, Massachusetts, being all and singular the premises described in said mortgage to wit: Parcel 1: Beginning at a highway monument in the Southwesterly sideline of State Highway Route 20, all as more particularly shown on a plan entitled "Plan of Land in Becket, MA, Surveyed for L. Gilbert Biron and Margaret M. Biron, November, 1980," which plan has been recorded with the Berkshire Middle District Registry of Deeds where it is designated as Plan No. 97 filed in Drawer C; Thence South 52 degrees 05 minutes 04 seconds East along said Southwesterly sideline of Routes 8 and 20, a distance of 216.96 feet to an iron pipe set; Thence South 25 degrees 09 minutes 06 seconds West a distance of 177.56 feet to an iron pipe set at or near an old stone wall; Thence North 84 degrees 44 minutes 32 seconds West along said stone wall a distance of 225.29 feet; Thence continuing North 82 degrees 18 minutes 49 seconds West along said stone wall a distance of 148.23 feet to an iron pipe set in the Easterly sideline of said State Highway Route 8; Thence Northerly along the Easterly sideline of said Route 8 along a curve to the left of a radius, which curve has a length of 56.34 feet and a radius of 2426.16 feet, a distance of 56.34 feet to a point; Thence continuing North 00 degrees 49 minutes 36 seconds West along the Easterly sideline of said Route 8, a distance of 210.54 feet to an iron pipe found; Thence along a roadway connecting said Route 8 with Route 20 on a curve to the right of radius, which curve has a length of 194.20 feet and a radius of 90.00 feet a distance of 194.20 feet to a point; Thence continuing along said roadway and along the Southwesterly sideline of said Route 20 South 57 degrees 11 minutes 45 seconds East, a distance of 166.54 feet to the Massachusetts Highway bound which marks the place of beginning. Being Lot #7 on the plan entitled "Plan of Land in Becket, MA, Surveyed for L. Gilbert Biron and Margaret M. Biron, November, 1980," which plan has been recorded with the Berkshire Middle District Registry of Deeds where it is designated as Plan No. 97 filed in Drawer C, containing 2.90 acres. Together with a right of way in common with others, more particularly being Lots 5,6,8 and 9, which right of way is 10-feet in width and is shown on said Plan along the Westerly and Southerly sides of Lot #6 and the Southerly and one of the Westerly side lines of Lot #5 on said Plan. Said 10 foot right of way intersects the existing 40-foot wide right of way now or formerly owned by L. Gilbert Biron which leads Southerly to Shaw Pond. Said 40-foot wide right of way is shown on a s Plan filed in the Berkshire Middle Registry of Deeds in Book 417G, Page 33 entitled "Definitive Plan of Lots laid out by Gilbert Biron in Becket, Mass. July 1972." There is also conveyed a right of way in common with others entitled thereto over said 40-foot wide right of way to and from Shaw Pond. ALSO: The land situated in the Town of Becket, County of Berkshire, Commonwealth of Massachusetts, more particularly bounded and described as follows: PARCEL ONE: Beginning at a Massachusetts Highway monument in the Easterly sideline of State Highway Route 8; Thence following along the Easterly sideline of said Route 8; Northerly in the line of a curve to the left having a radius of 2426.16 feet an arc distance of 202.57 feet to an iron pipe; Thence S 82-18-49E 148.23 feet to a point; Thence S 84-44-32E 225.29 feet to an iron pipe; Thence S 03-31-52E 258.41 feet to an iron pipe; Thence N 76-24-01W 408.84 feet to the point of beginning. The above described parcel contains 2.00 acres of land and is Lot 8 as shown on a plan entitled "Plan of Land in Becket, MA., Surveyed for L. Gilbert Biron and Margaret M. Biron, November, 1980," which plan has been recorded with the Berkshire Middle District Registry of Deeds where it is designated as Plan No. 97 filed in Drawer C . Also conveying a right of way over other land now or formerly of L. Gilbert Biron. Said right of way is to be 10' wide and adjacent to the Easterly boundary of the above-described parcel. From the Southeast corner of the above-described parcel the said 10 foot wide right of way shall extend Southerly until it intersects the Northeasterly line of land known as "Idle Hours Estates section of Shawnee Shores Estate." Thence the said 10 foot wide right of way shall run Southeasterly and then Southerly along said land known as "Idle Hours Estates section of Shawnee Shores Estates" until it intersects the existing 40 foot wide right of way owned by the grantors herein which leads Southerly to Shaw Pond. Said 40 foot wide right of way is shown on a plan filed in the Middle Berkshire Registry of Deeds in Book 417G, Page 33 entitled "Definitive Plan of Lots laid out by Gilbert Biron in Becket, Mass. July 1972." The grantee herein are also conveyed a right of way over said 40 foot wide right of way to and from Shaw Pond. For Mortgagor's title, see deed recorded in Book 7227, Page 223. The above-described premises will be sold SUBJECT TO all rights, easements, restrictions, and reservations of record insofar as the same are in force and applicable. The above premises will be sold subject as above and subject to and/or with the benefit of any and all outstanding tax titles, municipal or other public taxes, assessments, association dues, liens, restrictions, easements, improvements, covenants, or claims in the nature of liens, assessments or liens and/or rights of tenants and parties in possession, if any. TERMS OF SALE: A deposit of TEN THOUSAND ($10,000.00) DOLLARS shall be required to be made to the mortgagee in cash, by certified or by cashier's check at the time and place of the sale as a deposit.
