NOTICE OF SALE NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE Premises: 2431 Hancock Road, Hancock, MA 01237 By virtue and in execution of the Power of Sale contained in a certain mortgage given by Craig R. Smith to Statewide Funding of Western Massachusetts, Inc., dated February 15, 1991, and recorded with the Berkshire County (Middle District) Registry of Deeds in Book 825, Page 1065, of which mortgage the undersigned is the present holder by assignment, by an assignment of mortgage from M&T Mortgage Corporation, successor by merger to Statewide Funding Corporation to Secretary of Housing and Urban Development, dated July 16, 1996, and recorded with said Registry in Book 919, Page 597, by assignment of mortgage from The Secretary of Housing and Urban Development to Salomon Brothers Realty Corp., dated January 19, 2001, and recorded with said Registry in Book 1024, Page 1037, by an assignment of mortgage from Citigroup Global Markets Realty Corp, f/k/s Salomon Brothers Realty Corp. to HSBC Bank USA, National Association, not in its individual capacity but solely as Trustee of Citigroup Mortgage Loan Trust 2005-HE2, dated February 6, 2021, and recorded with said Registry in Book 1779, Page 904, by an assignment of mortgage from HSBC Bank USA, National Association, in its capacity as Trustee for the Citigroup Mortgage Loan Trust, Inc., Asset-Backed Pass-Through Certificates, Series 2005-HE2 to Citibank, N.A., as Trustee for CMLTI Asset Trust, dated October 27, 2021, and recorded with said Registry in Book 1779, Page 910, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold by Public Auction at 12 o'clock P.M. on the 25th day of February 2026 at the mortgaged premises located at 2431 Hancock Road, Hancock, MA 01237, Berkshire County (Middle District) County, Massachusetts, all and singular the premises described in said mortgage, To wit: The land with any and all buildings thereon, located on Route 43 in the Town of Hancock, Berkshire County (Middle District) County, Massachusetts, bounded and described as follows: Beginning in the Center of the Highway leading from Hancock to Williamstown, Mass; Thence North 64 West, one chain seventy-five links to stake and stones; Thence North 25 East to a stake and stones, one chain and ninety-seven links; Thence 45 40' East to Center of said highway, one chain and eighty links; Thence South 27 West, to place of beginning, two chains and two links. Being the North School lot, so-called Excepting from the above such portions thereof and the rights therein as were taken for highway purposes by the Berkshire County (Middle District) County Commissioners by order of taking dated May 01, 1962 and recorded in the Northern Berkshire County (Middle District) Registry of Deeds at Adams, Massachusetts, in Book 568, Page 158. Being the same premises conveyed to the Grantors herein by Deed of William J. Morris and Eleanor V. Morris, Dated October 29, 1968 and recorded in the Berkshire County (Middle District) Norther District Registry of Deeds in Book 762, Page 991. Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. TERMS OF SALE: A deposit of Ten Thousand Dollars ($10,000.00) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. High bidder to sign written memorandum of sale upon acceptance of the high bid. The balance of the purchase price is to be paid by certified or bank check at Friedman Vartolo LLP, 132 Franklin Avenue, Suite 160, Garden City, New York 11530 within thirty (30) days from the date of the sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
