LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Christopher S. Gallagher to Greylock Federal Credit Union, dated October 29, 2010 and recorded in Berkshire County (Middle District) Registry of Deeds in Book 4653, Page 163 (the "Mortgage") of which mortgage AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB, Trustee is the present holder by Assignment from Greylock Federal Credit Union to AJX Mortgage Trust I A Delaware Trust, Wilmington Savings Fund Society, FSB Trustee dated November 23, 2016 and recorded at said Registry of Deeds in Book 5888, Page 65, and Assignment from AJX Mortgage Trust I, A Delaware Trust, Wilmington Savings Fund Society, FSB Trustee to U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to Ajax Mortgage Loan Trust 2017-A, Mortgage-Backed Notes, Series 2017-A dated June 7, 2017 and recorded at said Registry of Deeds in Book 5985, Page 17, and Assignment from U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to AJAX Mortgage Loan Trust 2017-A, Mortgage-Backed Notes, Series 2017-A to AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB, Trustee dated January 6, 2020 and recorded at said Registry of Deeds in Book 06560, Page 230, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 40 Franklin Street, Dalton, MA 01226 will be sold at a Public Auction at 12:00 PM on March 3, 2021, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: PARCEL I: Being Lot number thirteen (13) as shown on "Revised Plan of Lots of E.M. Carty and G.H. Schnopp in Dalton, Mass., August 1929 - Revision of June 23, 1930" and drawn by W.O. Pease, Surveyor, and a copy of which Plan is on file with the Berkshire Middle District Registry of Deeds in Pittsfield in Drawer No. 114, and to which Plan reference may be had for a more particular description. Said Lot number thirteen (13) is situated on the southerly side of Franklin Street, and is bounded northerly by said Franklin Street, sixty-four (64) feet; Easterly by lot number twelve (12) on said plan, one hundred thirty-seven and thirty-eight hundredths (137.38) feet; Southerly by Merriam Street as shown on said Plan, sixty-five and forty-nine hundredths (65.49) feet; and Westerly by lot number fourteen (14) on said Plan, one hundred fifty one and twenty-eight hundredths (151.28) feet. PARCEL II: A parcel of land adjoining Lot 13 on the east and bounded northerly by the southerly line of said Franklin Street thirty-two (32) feet; easterly by the westerly line of a parcel of land conveyed by Arthur L. Packard and Annie L. Packard to Edward H. and Doris Merriam by deed dated April 5, 1961 recorded in said Registry at Book 719, Page 291; southerly by southerly line of Lot 12 on said Plan, thirty-two and 745/1000 (32.745) feet and westerly by the easterly line of said Lot 13, 137.38 feet, and comprising the westerly one-half of said Lot 12. Being the same premises conveyed by John W. Richardson, Executor under the Will of Clara R. Crossin to the mortgagor herein by deed dated July 15, 2005 and recorded with the said Registry of Deeds in Book 3272, Page 338. For mortgagor's title see deed recorded with the Berkshire County (Middle District) Registry of Deeds in Book 3273, Page 338. The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession. Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA 01851 or such other time as may be designated by mortgagee.
