COMMONWEALTH OF MASSACHUSETTS The Trial Court Probate and Family Court Department Berkshire Division Docket No. BE25E0015 TO: Theresa M. Roche of Pittsfield, Massachusetts and all other persons interested; A Petition for Partition, dated November 20, 2025 and filed November 21, 2025, has been presented to said Court by David G. MacDonald of Dalton, Massachusetts, representing that he holds as joint tenant an undivided part or share in certain real estate situate in Pittsfield, Berkshire County, Massachusetts, and described as follows: (Locus of real estate: 99 Boylston Street Extension, Pittsfield, Massachusetts) PARCEL I: Beginning at a point 180 feet easterly from the intersection of the southerly line of Boylston Street and the easterly line of Hollister Street, so-called; thence in an easterly direction in the said southerly line of Boylston Street a distance of 60 feet; thence in a southerly direction in a line somewhat perpendicular to the said southerly line of Boylston Street a distance of 132 feet to a point; thence in a westerly direction in a course parallel with the said southerly line of Boylston Street a distance of 60 feet; thence in a northerly direction in a course parallel to the easterly boundary of the parcel herein described a distance of 132 feet to the place of beginning. PARCEL II: That certain piece or parcel of land located in Pittsfield in said County and Commonwealth and shown and designated as Lot No. 34 on a plan of Building Lots belonging to Daniel J. Walsh, made by A. J. Kohlhofer, Engineer, December 1920. Said Lot No. 34 being located on the southerly side of Boylston Street, sometimes referred to as Boylston Street Extension. This conveyance is made subject to the taking of a sewer easement by the City of Pittsfield by an instrument recorded in the Berkshire Middle District Registry of Deeds in Book 777, Page 158. Being the same premises conveyed to David G. MacDonald and Theresa M. Roche by deed of Darren E. Rawson, Trustee of the Darren E. Rawson Trust recorded with the Berkshire Middle District Registry of Deeds on January 15, 2021 in Book 6822, Page 338. And setting forth that the petitioner wishes to hold the real estate in severalty; and that he desires that all of said land may be sold at private sale for not less than $275,000.00 and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition of all, or any part of said land which the Court finds cannot be advantageously divided at private sale or public auction; and be ordered to distribute the net proceeds thereof in such manner as to make the partition just and equal. If you desire to object thereto, you or your attorney should file a written appearance in said Court at 44 Bank Row, Pittsfield, MA 01201, before ten o'clock in the forenoon on the 23rd day of January, 2026, the return day of this citation.
