LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by William J. Mahoney and Sheryll L. Mahoney to Argent Mortgage Company, LLC, dated January 8, 2004 and recorded in Berkshire County (Middle District) Registry of Deeds in Book 2830, Page 131 (the "Mortgage") of which mortgage Citigroup Mortgage Loan Trust 2022-RP1 by U.S. Bank Trust National Association, not in its individual capacity, but solely as Owner Trustee is the present holder by Assignment from Argent Mortgage Company, LLC. to Deutsche Bank National Trust Company, as Trustee for, Argent Securities Inc. Asset- Backed Pass-Through Certificates, Series 2004-W7, under the Pooling and Servicing Agreement dated May 1, 2004 dated January 27, 2009 and recorded at said Registry of Deeds in Book 4242, Page 178, and Assignment from Deutsche Bank National Trust Company, as Trustee for, Argent Securities Inc. Asset- Backed Pass-Through Certificates, Series 2004-W7 to U.S. Bank National Association, not in its individual capacity but solely as Trustee for the NRZ Pass-Through Trust XI-B dated January 21, 2022 and recorded at said Registry of Deeds in Book 7126, Page 124, and Assignment from U.S. Bank National Association, not in its individual capacity but solely as Trustee for the NRZ Pass-Through Trust XI-B to Citigroup Mortgage Loan Trust 2022-RP1 by U.S. Bank Trust National Association, not in its individual capacity, but solely as Owner Trustee dated December 30, 2024 and recorded at said Registry of Deeds in Book 7755, Page 333, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 37 Broadview Terrace, Pittsfield, MA 01201 will be sold at a Public Auction at 12:00 PM on December 2, 2025, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: PARCEL I: Being Lot #362 on a plan of lots on Morningside Park made for Henry J. Miller by Barnes & Spaulding, Engineers, dated April 1910, a copy of which plan is recorded in the Berkshire Middle District Registry of Deeds at Pittsfield in Book 347, Page 631. The said Lot #362 has a width of 50 feet on Broadview Terrace and extends back there from 171.24 feet. PARCEL II: Being designated as Lot #361 on a plan of Lots on Morningside Park for Henry J. Miller by Barnes & Spaulding, Engineers, dated April 1910, a copy of which plan is recorded in said Registry of Deeds as said Pittsfield in Book 347, Page 631. The lot hereby conveyed has a width of 50 feet on a proposed street called Broadview Terrace and extends back there from 170.53 feet. For mortgagor's title see deed recorded with the Berkshire County (Middle District) Registry of Deeds in Book 2019, Page 270. The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession. Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
