MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE 200 W Housatonic Street Pittsfield MA 01201 By virtue and in execution of the Power of Sale contained in a certain Mortgage given by David E. Sekac to Citizens Bank, N.A., dated August 24, 2018 and recorded in Berkshire County Registry of Deeds in Book 6279, Page 286, of which mortgage the undersigned is the present holder, for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction on November 12, 2025 at 12:00PM local time upon the premises 200 W Housatonic Street, Pittsfield, MA 01201, all and singular the premises described in said Mortgage, to wit: THE CONDOMINIUM UNIT IN SAID PITTSFIELD, BERKSHIRE COUNTY, MASSACHUSETTS, DESCRIBED AS FOLLOWS: THE FOLLOWING PREMISES IN THE PARK PLACE CONDOMINIUMS AT 200 WEST HOUSATONIC STREET, CITY OF PITTSFIELD, COUNTY OF BERKSHIRE, COMMONWEALTH OF MASSACHUSETTS, CREATED BY MASTER DEED DATED FEBRUARY 15, 1989 AND RECORDED ON FEBRUARY 16, 1989 IN THE BERKSHIRE MIDDLE DISTRICT REGISTRY OF DEEDS IN BOOK 1261, PAGE 502 AND C, UNIT NUMBER 3 TOGETHER WITH AN UNDIVIDED 5.1 PERCENT INTEREST APPERTAINING TO THE SAID UNIT IN THE COMMON ELEMENTS OF THE SAID CONDOMINIUM AND TOGETHER WITH THE RIGHTS AND EASEMENTS APPURTENANT TO SAID UNIT, IF ANY, AS SET FORTH IN THE MASTER DEED. SAID UNIT IS INTENDED SOLELY FOR THE RESIDENTIAL PURPOSES AS SET FORTH IN SECTION 8 OF THE MASTER DEED, AND IS SUBJECT TO THE RESTRICTIONS AS SET FORTH IN SECTION 9 OF THE MASTER DEED THAT: ALL OF THE UNITS AND THE COMMON ELEMENTS OF THE CONDOMINIUM SHALL BE FOR RESIDENTIAL PURPOSES AND SHALL BE SUBJECT TO THE RESTRICTIONS THAT, UNLESS OTHERWISE PERMITTED BY INSTRUMENT IN WRITING DULY EXECUTED BY THE BOARD OF MANAGERS PURSUANT TO THE PROVISIONS OF THE BY-LAWS OF PARK PLACE CONDOMINIUMS ASSOCIATION DATED FEBRUARY 15, 1989 AND RECORDED IN SAID REGISTRY AS EXHIBIT C TO THE MASTER DEED (THE BY-LAWS). The premises are to be sold and conveyed "as is" subject to and with the benefit of all rights, rights of way, easements, restrictions, covenants, encroachments, building and zoning laws, liens, improvements, unpaid taxes, tax titles, water and sewer liens, municipal liens and assessments, and any other encumbrances of record which are in force and applicable having priority over said mortgage whether or not reference to such restrictions, easements, improvements, liens, encumbrances is made in the deed and will be subject to any rights of redemption for unpaid federal taxes, if any, as shall, notwithstanding this provision, constitute valid liens or encumbrances thereon after said sale, rights of tenants and parties in possession, and attorney's fees and costs if any, which take precedence over the said mortgage above described. TERMS OF SALE: A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check, bank treasurer's check or money order at the time and place of sale will be required to be Paid by the purchaser in the form of certified funds at the time and place of sale. The Deposit shall be forfeited to the mortgagee if the successful bidder does not comply strictly with the terms of the Memorandum of sale. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified funds to Albertelli Law, 5404 Cypress Center Dr., Ste 300, Tampa, FL 33609. A deed will be provided to the purchaser for recording upon receipt of the full purchase price. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. The description of the premises contained in said mortgage shall control in the event of an error in this publication. By order of the present holder of said Mortgage which hereby gives notice of its intention to bid as said sale or at any adjournment or postponement thereof. TIME WILL BE OF THE ESSENCE.
