Shultis, late of Erie, New York, including Etta Shultis, Gregory Shultis, Michelle Majerskie, Peter Shultis, Justine Shultis, John and Jane Doe, as Heirs, Devisees, Representatives, and/or Assigns of Brian A. Shultis, and Such Other Persons, if any, unascertained, not in being, unknown, within or without the Commonwealth or who cannot be served with process, their heirs or legal representatives or such persons as shall become their heirs, devisees, representatives, and/or assigns, WHEREAS, the Plaintiffs have filed a civil action against you, entitled as above, wherein the Plaintiffs seek, among other things, a declaration against the Defendants or their heirs, devisees, representatives, and/or assigns, that the Plaintiffs hold title in fee simple or, in the alternative, have acquired title in fee by virtue of the doctrine of ouster/adverse possession, and that the Defendants or their heirs, devisees, representatives, and/or assigns, be forever restrained and foreclosed from making any claim of title, with regard to certain premises located at 100 Hillsdale Road in Egremont, Berkshire County, Massachusetts described in that certain deed of Andrew J. Baldwin, Jr., as Ancillary Administrator of the Estate of Evelyn J. Shultis to Owen D. Shultis, dated February 27, 1998 and recorded in the Berkshire Southern District Registry of Deeds in Book 1058, Page 175 on April 6, 1998, and WHEREAS, the Berkshire Superior Court has ordered that service of process on you may be made by publication, TAKE NOTICE, in order to preserve your rights, you or your attorney should file an answer in said Court at Pittsfield, in said County of Berkshire, on or before the 20th day after this date of publication, which day is the return day of this subpoena, or judgment by default may enter against you.
