MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by FRANK W. LYNCH and JACQUELINE J. Subject to a 20' wide sewer easement reserved by Delalba Realty, Inc., as shown on said Plan. See Revised Sewer Easement Plan recorded in said Registry in Book 417I, Page 36A. Subject to the rights, privileges and easement granted to Western Massachusetts Electric Company by Elizabeth P. McDonough, et als, dated April 4, 1958, and recorded in said Registry in Book 672, Page 213, to the extent the same may be applicable. Being the same premises conveyed to the mortgagors herein by deed of William M. Hines, trustee of the William M. Hines Revocable Trust and Mary Ellen Hines, trustee of the Mary Ellen Hines Revocable Trust, dated June 5, 2015 and recorded in the Berkshire Middle District Registry of Deeds immediately prior to this instrument. Said premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, prior liens, mortgages and other enforceable encumbrances of record having priority over the mortgage described herein, and subject to, and with the benefit of, all easements, restrictions, improvements, reservations and conditions of record, and all tenancies and/or rights of parties in possession, including rights or claims to personal property installed by tenants or former tenants now located on the premises. It shall be the bidder's sole responsibility to ascertain all items described in this paragraph and no representations are made concerning compliance with applicable zoning, building, sanitary or other state and/or municipal laws, ordinances or regulations.
