NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Jeannine M. Poulton, Jennifer L. Rose to Mortgage Electronic Registration Systems, Inc., as nominee for Academy Mortgage Corporation, dated September 26, 2014 and recorded in the Berkshire County (Middle District) Registry of Deeds in Book 5445, Page 70, of which mortgage the undersigned is the present holder, by assignment from: Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Academy Mortgage Corporation, its successors and assigns to PennyMac Loan Services, LLC, recorded on March 18, 2026, in Book No. 7991, at Page 213 for breach of the conditions of said mortgage and for the purpose of foreclosing, the same will be sold at Public Auction at 12:00 PM on August 5, 2026, on the mortgaged premises located at 65 Cecelia Terrace, Pittsfield, Berkshire County, Massachusetts, all and singular the premises described in said mortgage, TO WIT: Beginning at a stake set in the easterly line of Cecelia Terrace, said stake being also in the northerly line of land now owned by the Boston and Albany Railroad Company; thence northeasterly along the said northerly line of said Railroad Company one hundred forty-seven and sixty-six one-hundredths (147.66) feet to a stake; thence northwesterly along the westerly line of Lot #27, seventy and ninety-three one-hundredths (70.93) feet to a stake; thence southwesterly along the southerly line of Lot #18, one hundred thirty and seventy-one one-hundredths (130.71) feet to a stake set in the said easterly line of Cecelia Terrace; thence southeasterly along the said easterly line of Cecelia Terrace fifty-five and sixty-three one hundredths (55.63) feet to the place of beginning. Being Lot #19 as shown on a plan entitled "Plan of Building Lots, Laid out by Earl L. Roberts, Pittsfield, Mass., Scale 1" = 40' Nov. 1929, A.J. Kohlhofer-Engineer," said plan is recorded in the Berkshire Middle District Registry of Deeds, at Pittsfield, in Drawer 77. The above described premises are conveyed subject to an easement from Sam Friedland to the Western Massachusetts Electric Company, dated June 5, 1946, and recorded in said Registry of Deeds, in Book 500, Page 612. The above described premises are conveyed further subject to an easement for purpose of public way taken in an order of the City of Pittsfield "Laying Out and Establishing and Accepting Cecelia Terrace" as a public way dated July 9, 1957 and recorded in the said Registry of Deeds in Book 660, Page 219&c. For mortgagor's(s') title see deed recorded with Berkshire County (Middle District) Registry of Deeds in Book 5445, Page 67. These premises will be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. TERMS OF SALE: A deposit of Five Thousand ($5,000.00) Dollars by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at Harmon Law Offices, P.C., 150 California St., Newton, Massachusetts 02458, or by mail to P.O. Box 610389, Newton Highlands, Massachusetts 02461-0389, within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
