MORTGAGEE'S NOTICE OF SALE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Steven R. White and April L. White to Greylock Federal Credit Union dated February 3, 2010, recorded with Berkshire Middle Registry of Deeds Book 4484, Page 228, which mortgage was assigned to AJX Mortgage Trust I, A Delaware Trust, Wilmington Savings Fund Society, FSB Trustee by Assignment dated November 23, 2016, recorded in Book 5888, Page 140; further assigned to U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to Ajax Mortgage Loan Trust 2017-A, Mortgage -Backed Notes, Series 2017-A by Assignment dated June 21, 2017, recorded in Book 6007, Page 273; further assigned to AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB, Trustee by Assignment dated January 6, 2020, recorded in Book 6560, Page 251; further assigned to Ajax Mortgage Loan Trust 2021-B, by U.S. Bank National Association, as Indenture Trustee by Assignment dated May 18, 2021, recorded in Book 6959, Page 40; and further assigned to Wilmington Savings Fund Society, FSB, as Owner Trustee of the Residential Credit Opportunities Trust X-A by Assignment dated August 20, 2024, recorded in Book 7676, Page 237, of which mortgage the undersigned is the present holder, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 11:00 AM, on the 10th day of December, 2024, at the mortgaged premises described and known as 20 Greenway Street, Pittsfield, Massachusetts described in said mortgage, to wit: A certain parcel of real estate with buildings thereon, situate on the east side of Greenway Street, so-called, in said Pittsfield: Beginning at a point in the easterly line of said Greenway Street, one hundred ninety-eight (198) feet from its intersection with the northerly line of Woodleigh Avenue, so-called, and sixty-six (66) feet northerly of a stone bound set in the northwest covering of land now or late of John J. Higgins; thence easterly and parallel with Higgins' north line, one hundred thirty-two (132) feet; thence northerly parallel with Greenway Street, sixty-six (66) feet; thence westerly parallel with the first course, one hundred and thirty-two (132) feet to the easterly line of Greenway Street; thence southerly in said easterly line of Greenway Street, sixty-six (66) feet to the place of beginning. Said premises are conveyed subject to all liens and encumbrances of record, if any. The Mortgagee reserves the right to postpone the sale to a later date by public proclamation at the time and date appointed for the sale and to further postpone at any adjourned sale date by public proclamation at the time and date appointed for the adjourned sale date. The Mortgagee further reserves the right to open the bidding at the time, date and place appointed for sale, and if no bids are received, or the bids received are deemed unacceptable to Mortgagee, to postpone the sale to a later date by public proclamation. Said premises will be sold subject to and with the benefit of all restrictions, easements, improvements, outstanding tax titles, mortgages, liens, rights of tenants and parties in possession, unpaid taxes, municipal liens and other public taxes, assessments or liens, having priority over the mortgage described herein, if any. In the event that the successful bidder at the foreclosure sale shall default in purchasing the within described property according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by Foreclosure Deed to the second highest bidder provided that the second highest bidder shall deposit with Mortgagee's attorneys the amount of the required deposit as set forth herein within three (3) business days after written notice of default of the previous highest bidder and title shall be conveyed to said second highest bidder within twenty (20) days of said written notice. TERMS OF SALE: Ten Thousand Dollars ($10,000.00) will be required to bid and be paid in cash or by certified check at the time and place of sale as earnest money. The balance is to be paid in cash or by certified check within thirty (30) days of the date of the sale at the Law Office of Michael J. Murphy, 5 Commonwealth Road, Natick, Massachusetts 01760. The description of the premises contained in said mortgage shall control in the event of any typographical error in this publication.
