NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS November 15, 2024 Town of Becket 557 Main Street Becket, MA 01223 413-623-8934 On or about November 27, 2024 the Town of Becket will submit a request to the Commonwealth of Massachusetts for the release of Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974 (PL 93-383), as amended, to undertake the following projects, totaling $999,810.00 FY2024 Becket-Dalton Housing Rehabilitation Program for the purpose of rehabilitating 14 residential units in the Towns of Becket and Dalton, MA. The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Becket Town Hall at 557 Main Street, Becket, MA 01223, and may be examined or copied upon request on Monday - Friday from 8:30A.M to 4:30 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to Katherine Warden, the CDBG Environmental Certifying Officer, Town of Becket, 557 Main Street, Becket, MA 01223. All comments received by 3:00 PM, Tuesday, November 26th, 2024, will be considered by the Town prior to authorizing submission of a request for release of funds. ENVIRONMENTAL CERTIFICATION The Town of Becket certifies to the Commonwealth of Massachusetts that Katherine A. Warden in her capacity as the Town of Becket Town Administrator and CDBG Environmental Certifying Officer consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Commonwealth's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Towns of Becket to use Program funds. OBJECTIONS TO RELEASE OF FUNDS The Commonwealth of Massachusetts will accept objections to its release of funds and the Town of Becket's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Town of Becket; (b) the Town of Becket has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by The Commonwealth of Massachusetts; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Massachusetts Community Development Block Grant Department of Executive Office of Housing and Livable Communities, 100 Cambridge Street, Suite 300, Boston, MA 02114.
