COMMONWEALTH OF MASSACHUSETTS The Trial Court Probate and Family Court Department Berkshire Division Docket No: BE25E0009 TO: J. Scott Hansen of Otis, Massachusetts and all other persons interested; An Amended Petition for Partition, dated June 3, 2025 and filed on June 6, 2025, has been presented to said Court by JAD Berkshire Properties, LLC, Jeremy B. Rawitz, Member/Manager/Real Property Signer, of, Monterey, Massachusetts, representing that it holds as tenant in common an undivided part or share in certain real estate situate in Otis, Berkshire County, Massachusetts, and described as follows: The jointly owned property (the "Jointly Owned Property" on Hayes Pond Road and West Center Road in Otis, Massachusetts, by virtue of a certain Deed from Barbarba Shore dated April 2, 1991 and recorded on April 8, 1991, with the Berkshire County (Middle District) Registry of Deeds in Book 1324, Page 884. The Jointly Owned Property consists of two parcels: Otis Assessor's Parcel ID 9A-17 on Hayes Pond Road and Otis Assessor's Parcel ID 9A-77 on West Center Road, Otis, Massachusetts. The Jointly Owned Property is described in the Joint Deed as follows: Beginning at a point in the southwest corner of Lot 11-L and the southeast corner of Lot 12L, said point being in the middle of a 50 foot right of way; thence along the middle of said right of way N 68 11' 55" E 110. 00 feet to a point; thence N 54 35' 16" E 209.92 feet to a point; thence N 78 41' 24" E 112.01 feet to a point; thence N 55 19' 47" E 156.96 feet to a point; thence N 28 50' 23" E 258.28 feet to a point; thence N 59 02' 11" E 112.56 feet to a point in the southeast corner of Lot 10-L; thence in a southerly direction along the west shore of Hayes Pond to the northeast corner of Lot 21-L; thence S 87 37' 52" W 540 feet, more or less, to the southwesterly corner of Lot 11-L at the point and place of beginning. Together with all of the grantors right, title and interest to whatever other land and rights of any kind not previously conveyed which was not depicted by lot designation and number on any of the following plans: Plans prepared by "Heritage Surveys, Inc. Registered Land Surveyors, College Highway Southhampton, Mass. ", which plans are described as follows: A. "Plan of Lots in Otis, Massachusetts Prepared for Roberts Associates, Inc. Date July 18, 1977 Scale 1 " = 200 ', recorded in said Registry in Drawer A-68. B. "Plan of Lots in Otis, Massachusetts Prepared for Roberts Assoc., Inc. January 16, 1968 Scale l" = 200 '", recorded in said Registry in Drawer B-4. C. "Plan of Lots in Otis, Massachusetts Prepared for Roberts Associates Inc. Date July 18, 1977 Scale l" = 200 "', recorded in said Registry in Drawer A-67. Jeremy B. Rawitz transferred his interest in the property to JAD BERKSHIRE PROPERTIES, LLC by a deed from Jeremy B. Rawitz dated March 24, 2022 and recorded on April 14, 2022 with the Berkshire Middle District Registry of Deeds at Book 7168, Page 270. And setting forth that the petitioner desires that all of said land may be sold at public auction and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition of all, or any part of said land which the Court finds cannot be advantageously divided at public auction; and be ordered to distribute the net proceeds thereof in such manner as to make the partition just and equal. If you desire to object thereto, you or your attorney should file a written appearance in said Court at 44 Bank Row, Pittsfield, MA 01201, before ten o'clock in the forenoon on the 31st day of July, 2025, the return day of this citation.
