Notice of Intent to Request the Release of Funds (NOIRROF) 4/26/22 Town of Egremont 171 Egremont Plain Road PO Box 368 Egremont, MA 01258-0368 TO ALL INTERESTED AGENCIES, GROUPS AND PERSONS: On or about the 12th day of May, 2022 the Town of Egremont will submit a request to the Commonwealth of Massachusetts Department of Housing and Community Development (DHCD) for the release of CDBG funds under Title I of the Housing and Community Development Act 1974 (PL 93-383) as amended to undertake a project known as the Egremont Regional Housing Rehabilitation Program for the purpose of completing moderate rehabilitation of homes in the towns of Egremont, Great Barrington and Monterey totaling up to $962,000. The activity proposed is categorically excluded under HUD regulations at 24 CFR Part 58 from the National Environmental Policy Act (NEPA) requirements. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at Egremont Town Hall and is available for public examination and copying, upon request weekdays between the hours of 8:30 a.m. and 4:00 p.m. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to George McGurn, Chairman of the Select Board at Egremont Town Hall on or before May 11, 2022. All such comments so received will be considered prior to authorized submission of a request for release of funds. RELEASE OF FUNDS The Town of Egremont certifies to DHCD that George McGurn, in his official capacity as Environmental Certifying Officer, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's and Massachusetts DHCD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the Town of Egremont to use Program funds. OBJECTION TO RELEASE OF FUNDS Massachusetts DHCD will accept objections to its release of fund and the Town of Egremont certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: a) The certification was not in fact executed by the Town's Certifying Officer; b) The Town has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; c) The grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD or the Massachusetts Department of Housing and Community Development; or d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Massachusetts Community Development Block Grant, Department of Housing and Community Development, 100 Cambridge Street, Suite 300, Boston, MA 02114. Potential objectors should contact the Massachusetts Department of Housing and Community Development to verify the actual last date of the objection period.
