NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE Pursuant to the Conditional Judgment entered by the Superior Court for Berkshire County on April 16, 2019 in the matter assigned Docket Number 1876CV00267, and that Court's Order entered on December 24, 2019, and by virtue and in execution of the Power of Sale contained in a certain mortgage given by Chris Bonnivier, Jr. and Linda Rancourt to Greylock Federal Credit Union, dated January 18, 2008, and recorded with the Berkshire County (Northern District) Registry of Deeds in Book 1319, Page 665, as affected by an assignment from Greylock Federal Credit Union to AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB Trustee, dated November 23, 2016, and recorded with the Berkshire County (Northern District) Registry of Deeds in Book 1613, Page 483; and assignment from AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB Trustee to U.S. Bank National Association, as Indenture Trustee on Behalf of and with Respect to AJAX Mortgage Loan Trust 2017-A, Mortgage-Backed Notes, Series 2017-A, dated June 21, 2017, and recorded with the Berkshire County (Northern District) Registration of Deeds in Book 1629, Page 7; of which mortgage the undersigned is the present holder by assignment, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 02:30 PM o'clock on December 9, 2020 at 13 Beech Street, Adams, Berkshire County, Massachusetts, all and singular the premises described in said mortgage, To wit: The land in Adams, Berkshire County, Massachusetts more particularly described as follows: Beginning at the southeast corner of land conveyed by Sarah M. Alden to M.A. Andrews; Thence, South 54 40` East three (3) rods to an iron pin driven into the ground; Thence, North 33 East fourteen (14) rods and twenty-one (21) links to a take in the north line of land conveyed by L.L. Brown et als. to Sarah M. Alden; Thence North 67 1/4 West three (3) rods to the northeast corner of such Andrews` land; Thence South 33 West fourteen (14) rods and five (5) links to the place of beginning. Subject to and with the benefit, if any, in easement granted by Bernadette Bordeau et al. to William Edward Smith and Victoria Smith dated December 2, 1965, and recorded with Northern Berkshire District Registry of Deeds in Book 598, Page 70. Being the same premises conveyed by Linda Rancourt to Linda Rancourt and Chris Bonniver, Jr., by Deed Dated October 5, 2007 and Recorded with the Berkshire Northern District Registry of Deeds October 22, 2007 in Book 1310 Page 781. For mortgagor's title see deed recorded at the above-named Registry of Deeds in Book 1310, Page 781. Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. Terms of sale: A deposit of five thousand dollars ($5,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at the offices of WCG Law Group, PLLC, 21 High Street, Suite 208B, North Andover, MA 01845 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
