MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by RICHARD E. ROBICHAUD to GREYLOCK FEDERAL CREDIT UNION, dated October 29, 2018, and recorded on October 29, 2018, with the Berkshire Northern District Registry of Deeds in Book 1668, Page 825, of which mortgage the undersigned is the present holder, for breach of the conditions of the said mortgage and for the purpose of foreclosing, the same will be sold at public auction at 10:00 a.m. on the Twelfth (12th) day of August, 2021, at the mortgaged premises described below, to wit, 56 Baker Street, Lanesborough, Massachusetts, all and singular, the premises in said Lanesborough, Berkshire County, Massachusetts, described in said Mortgage, to wit: PARCEL ONE: That certain parcel consisting of five (5) lots numbered 376, 377, 378, 379 and 380 as shown on planoflots of Pontoosuc Gardens, said plan being made by Ernest W. Branch, Surveyor, dated July 1912, and recorded in the Berkshire Northern District Registry of Deeds at Adams, Massachusetts, in Drawer 8, of plans, Book 11. Said lots 376, 377, 378 and 379 being on Baker Street in said Town of Lanesborough, and each being thirty (30) feet in width and one hundred (100) feet deep. Lot 380, also being on Baker Street in said Town of Lanesborough, and being forty (40) feet wide and one hundred (100) feet in depth. Together with the fee insofar as we have the right to convey the same, of all the streets and ways shown on said plan in common with the owners of other lots shown on said plan, and subject to the right of all said lot owners to use said streets and ways. PARCEL TWO: Being PARCEL III on a plan entitled "Plan of Land Owned by John Wendling Baker St., Lanesboro, Mass. Scale: 1" = 20' December 1980 J.R. Clary, Surveyor", which said plan has been recorded with the said Registry of Deeds in Book 240J, Page 8. According to said plan, said PARCEL III is further bounded and described as follows: Beginning at an iron pipe set in the ground in the southerly line of Baker Street at a point that is two hundred (200) feet westerly along said southerly line of Baker Street from another iron pin set at the intersection of the southerly line of said Baker Street with the westerly line of Dell Street as shown on the aforesaid plan; Thence southerly along the westerly sideline of PARCEL II as shown on the aforesaid plan, one hundred (100) feet to another iron pipe set in the southwesterly corner thereof; Thence westerly along the southerly line of said PARCEL III, ten (10) feet to the southeasterly corner of other land belonging to the grantee herein; Thence northerly along the westerly sideline of said PARCEL III, it being also the easterly sideline of said other land of the grantee herein, one hundred (100) feet to a point in the southerly line of said Baker Street that is ten (10) feet westerly along said southerly line of Baker Street from the place of beginning; Thence easterly along said southerly line of Baker Street, ten (10) feet to the iron pipe set at the place of beginning. Being the same premises conveyed to the Mortgagor herein by deed of Fannie Mae a/k/a Federal National Mortgage Association recorded immediately prior hereto in said Registry of Deeds. Said premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, prior liens, mortgages and other enforceable encumbrances of record having priority over the mortgage described herein, and subject to, and with the benefit of, all easements, restrictions, improvements, reservations and conditions of record, and all tenancies and/or rights of parties in possession, including rights or claims to personal property installed by tenants or former tenants now located on the premises. It shall be the bidder's sole responsibility to ascertain all items described in this paragraph and no representations are made concerning compliance with applicable zoning, building, sanitary or other state and/or municipal laws, ordinances or regulations. TERMS OF SALE: FIVE THOUSAND DOLLARS ($5,000.00) will be required to be paid in cash or by certified check or bank cashier's check by the purchaser at the time and place of sale. The balance is to be paid in cash or by certified or bank cashier's check and the deed shall be delivered within twenty-one (21) days after the public auction at the offices of HASHIM & SPINOLA, 82 Wendell Avenue, Pittsfield, Massachusetts. The purchaser will be responsible for all the closing costs, recording fees, deed stamps and shall be required to sign an Auctioneer's Memorandum containing the terms of this sale. In the event the successful bidder shall default in purchasing the within described premises according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by Foreclosure Deed to the second highest bidder provided that the second highest bidder shall deposit with the Mortgagee's attorneys, HASHIM & SPINOLA, the amount of the required deposit as set forth herein within three (3) business days after written Notice of Default of the previous highest bidder, and title shall be conveyed to the said second highest bidder within twenty (20) days of said written notice. This sale may be postponed or adjourned from time to time, if necessary, by the attorney for the mortgagee at the scheduled time and place of sale. The description for the premises contained in said Mortgage shall control in the event of a typographical error in this publication. Other terms, if any, to be announced at the time and place of sale.
