NOTICE OF SECOND AMENDED AND RESTATED GRANT OF ENVIRONMENTAL RESTRICTION AND EASEMENT EPA Site Name: GE-Pittsfield/Housatonic River Site, DEP Site Name: GE Pittsfield Disposal Sites, DEP Disposal Site No.: GECD600, Site Location: three parcels of land located between Woodlawn Avenue, East Street and Silver Lake Blvd., Pittsfield, MA. In accordance with the requirements set forth in 310 CMR 40.1403(7), as amended, and a Consent Decree executed by the General Electric Company, the United States, the Commonwealth of Massachusetts, and other parties, entered by the U.S. District Court for the District of Massachusetts on October 27, 2000 in United States et al. v. General Electric Company (Civil Action No. 99-30225-MAP et. seq.), notice is hereby given that a Second Amended and Restated Grant of Environmental Restriction and Easement ("Amended Grant") on the above-referenced parcels (the "Property") owned by the Pittsfield Economic Development Authority ("PEDA") has been recorded in the Berkshire Middle District Registry of Deeds on June 16, 2021. The Amended Grant prohibits the following site activities and uses on the Property, except as otherwise provided in the Amended Grant: A. residential activity or use; B. day care activity or use; C. educational activity or use for children under 18 years of age, with the exception of educational activities or uses within the Berkshire Innovation Center Area; D. community center activity or use for children under 18 years of age; E. recreational activity or use; F. agricultural activity or use; G. extraction, consumption, or utilization of groundwater underlying the Property, including extraction for potable, industrial, irrigation, or agricultural use; H. excavation, digging, drilling, or other intrusive activity into or disturbance of the surface of the ground and/or the underlying soil; and I. any activity or use that would interfere with, or would be reasonably likely to interfere with, the implementation, operation, or maintenance of any aspect or component of the Response Actions already constructed or under construction, or of which Grantor has notice, including without limitation, interference with any groundwater contaminant containment measures or barriers or any groundwater monitoring wells if any are installed on the Property.
