NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by Dennis J. Tuper and Seth T. Tuper to Greylock Federal Credit Union, dated October 26, 2007, and recorded with the Berkshire County (Northern District) Registry of Deeds in Book 1311, Page 922, as affected by an assignment from Greylock Federal Credit Union to AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB Trustee, dated November 23, 2016, and recorded with the Berkshire (Northern District) Registry of Deeds in Book 1613, Page 419; assignment from AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB, Trustee to U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to Ajax Mortgage Loan Trust 2017-A, Mortgage-Backed Notes, Series 2017-A, dated June 6, 2017, and recorded with the Berkshire County (Northern District) Registry of Deeds in Book 1625, Page 1065; assignment from U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to Ajax Mortgage Loan Trust 2017-A, Mortgage-Backed Notes Series 2017-A to Ajax Mortgage Loan Trust 2019-F, Mortgage-Backed Securities, Series 2019-F, By U.S. Bank National Association, as Indenture Trustee, dated January 30, 2020, and recorded with the Berkshire County (Northern District) Registry of Deeds in Book 1709, Page 271; and corrective Assignment from U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to Ajax Mortgage Loan Trust 2017-A, Mortgage-Backed Notes, Series 2017-A to U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to Ajax Mortgage Loan Trust 2019-F, Mortgage-Backed Securities, Series 2019-F, dated May 29, 2020, and recorded with the Berkshire County (Northern District) Registry of Deeds in Book 1714, Page 981; of which mortgage the undersigned is the present holder by assignment, for breach of the conditions of said mortgage and for the purpose of foreclosing the same will be sold at Public Auction at 02:00 PM o'clock on July 22, 2021 at 101 N. County Road, Florida, Berkshire County, Massachusetts, all and singular the premises described in said mortgage, To wit: Beginning at a point which marks the southwest corner of land now or formerly of Gellese; thence turning and running in an easterly direction in a line parallel with the southerly line of Mohawk Trail Road to the southeast corner of land now or formerly of said Gallese; thence turning and running in a southerly direction to a point in the northerly line of said North County Road, which point is a distance of Six Hundred Forty (640) feet, more or less, along the northerly line of said North County Road from a point which marks the intersection of said North County Road and said Mohawk Trail Road; thence turning and running in southwesterly direction along the northerly line of said North County Road to an iron pin; thence turning and running in a northerly direction a distance of Four Hundred Eighteen (418) feet, more or less, to the point and place of beginning. Said parcel of land is shown as Parcel A on a sketch attached to deed of Myron Lawrence Burdick et ux to Lawrence A. Burdick et ux, dated September 15, 1972 and recorded with the Berkshire Northern District Registry of Deeds in Book 649, Page 466. EXCEPTING, therefrom, the parcel conveyed by George L. Heisler, Jr. et ux to Lawrence A. Burdick et ux, by deed dated July 6, 1979 and recorded with said Registry of Deeds in Book 693, Page 744. Being the same premises conveyed to the mortgagors herein by deed of Dennis J. Tuper and Laurie C. Tuper dated 10/26/07 and recorded with the Berkshire Northern District Registry of Deeds simultaneously herewith. For mortgagor's title see deed recorded at the above-named Registry of Deeds in Book 1311, Page 918. Premises to be sold and conveyed subject to and with the benefit of all rights, rights of way, restrictions, easements, covenants, liens or claims in the nature of liens, improvements, public assessments, any and all unpaid taxes, tax titles, tax liens, water and sewer liens and any other municipal assessments or liens or existing encumbrances of record which are in force and are applicable, having priority over said mortgage, whether or not reference to such restrictions, easements, improvements, liens or encumbrances is made in the deed. Terms of sale: A deposit of five thousand dollars ($5,000) by certified or bank check will be required to be paid by the purchaser at the time and place of sale. The balance is to be paid by certified or bank check at the offices of WCG Law Group, PLLC, 21 High Street, Suite 208B, North Andover, MA 01845 within thirty (30) days from the date of sale. Deed will be provided to purchaser for recording upon receipt in full of the purchase price.
