MORTGAGEE'S SALE OF REAL ESTATE By virtue and in execution of the Power of Sale contained in a certain mortgage given by ROBERT B. BRAZEE and YOLANDA Y. BRAZEE to GREYLOCK FEDERAL CREDIT UNION, dated June 6, 2014, and recorded on June 11, 2014, with the Berkshire Northern District Registry of Deeds in Book 1541, Page 78, of which mortgage the undersigned is the present holder, for breach of the conditions of the said mortgage and for the purpose of foreclosing, the same will be sold at public auction at 11:00 a.m. on the Twenty-Fifth (25th) day of April, 2024, at the mortgaged premises described below, to wit, 642 Notch Road, Cheshire, Massachusetts, all and singular, the premises in said Cheshire, Berkshire County, Massachusetts, described in said Mortgage, to wit: Beginning at an iron pipe driven in the ground in the southerly line of Notch Road, said pipe marking the northwesterly corner of land now or formerly of Stanley Poplaski, as shown on a plan entitled, "Plan of Land in Cheshire Mass., to be conveyed by Stanley P. Poplaski, Sr." dated March 1, 1983, on file in the Berkshire Northern District Registry of Deeds in Book 240 J, page 87; thence running southerly a distance of 630 feet, more or less, along the westerly line of said land now or formerly of Stanley Poplaski and the westerly line of land now or formerly of James and Dina Poplaski, to the southerly line of South Brook as shown on said plan; thence northwesterly, southwesterly and again northwesterly a distance of 770 feet, more or less, along said southerly line of South Brook to a point; thence northerly a distance of 390 feet, more or less, to an iron pipe in the ground; thence easterly along the southerly line of said land now or formerly of Stanley Poplaski, 300 feet, more or less, to an iron pipe in the ground; thence northerly a distance of 235 feet, more or less to an iron pipe in the southerly line of said Notch Road; thence easterly a distance of 420 feet, more or less, along the southerly line of Notch Road, to the point and place of beginning. Said Parcel contains 8.69 acres, more or less. Excepting therefrom portions thereof conveyed by Bonita Bush herein to Andrew J. MacRonald and Kerry A. MacRonald by deed dated May 20, 2008 and recorded in said Registry in Book 1331, Page 82, and to Keith A. McLear, Jr. and Aimee J. McLear by deed dated December 21, 2011 and recorded in said Registry in Book 1462, Page 766. Subject to easements granted by Bonita Bush herein to Andrew J. MacRonald and Kerry A. MacRonald by instrument dated March 10, 2010 and recorded in said Registry in Book 1403, Page 850 and to Massachusetts Electric Company by instrument dated March 10, 2010 and recorded in said Registry in Book 1406, Page 600. Being the entire remainder of the premises conveyed to Bonita Bush herein and her late husband Henry J. Bush by deed of Stanley Poplaski dated April 29, 1983 and recorded in said Registry in Book 719, page 332. The said Henry J. Bush died on November 19, 1994, see M-792 recorded in said Registry in Book 913, Page 278. This conveyance creates no new boundaries. For further title see Book 1486, Page 239&c. Said premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, prior liens, mortgages and other enforceable encumbrances of record having priority over the mortgage described herein, and subject to, and with the benefit of, all easements, restrictions, improvements, reservations and conditions of record, and all tenancies and/or rights of parties in possession, including rights or claims to personal property installed by tenants or former tenants now located on the premises. It shall be the bidder's sole responsibility to ascertain all items described in this paragraph and no representations are made concerning compliance with applicable zoning, building, sanitary or other state and/or municipal laws, ordinances or regulations. TERMS OF SALE: FIVE THOUSAND DOLLARS ($5,000.00) will be required to be paid in cash or by certified check or bank cashier's check by the purchaser at the time and place of sale. The balance is to be paid in cash or by certified or bank cashier's check and the deed shall be delivered within twenty-one (21) days after the public auction at the offices of HASHIM & SPINOLA, 82 Wendell Avenue, Pittsfield, Massachusetts. The purchaser will be responsible for all the closing costs, recording fees, deed stamps and shall be required to sign an Auctioneer's Memorandum containing the terms of this sale. In the event the successful bidder shall default in purchasing the within described premises according to the terms of this Notice of Sale and/or the terms of the Memorandum of Sale executed at the time of the foreclosure, the Mortgagee reserves the right to sell the property by Foreclosure Deed to the second highest bidder provided that the second highest bidder shall deposit with the Mortgagee's attorneys, HASHIM & SPINOLA, the amount of the required deposit as set forth herein within three (3) business days after written Notice of Default of the previous highest bidder, and title shall be conveyed to the said second highest bidder within twenty (20) days of said written notice. This sale may be postponed or adjourned from time to time, if necessary, by the attorney for the mortgagee at the scheduled time and place of sale. The description for the premises contained in said Mortgage shall control in the event of a typographical error in this publication.
