NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE Premises: 149 Wilshire Drive, Cheshire, Massachusetts By virtue and in execution of the Power of Sale contained in a certain mortgage given by Eric E. Guerrin to Mortgage Electronic Registration Systems, Inc., as nominee for Academy Mortgage Corporation, said mortgage dated March 30, 2018, and recorded in the Berkshire County (Northern District) Registry of Deeds, in Book 1650 at Page 715 and corrective mortgage from Eric E. Guerrin to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Academy Mortgage Corporation, its successors and assigns dated March 30, 2018 and recorded in Berkshire County (Northern District) Registry of Deeds in Book 1662, Page 831 and now held by PennyMac Loan Services, LLC by virtue of an assignment Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Academy Mortgage Corporation, its successors and assigns to PennyMac Loan Services, LLC dated November 12, 2019 and recorded in Berkshire County (Northern District) Registry of Deeds in Book 1698, Page 343, for breach of the conditions in said mortgage and for the purpose of foreclosing the same, will be sold at Public Auction on February 7, 2023 at 11:00 AM Local Time upon the premises, all and singular the premises described in said mortgage, to wit: Being all of lot numbered A6 as shown on a plan entitled "Subdivision Plan, Cheshire Hills, Section 3, Cheshire, Mass. prepared for Hutchinson Realty Trust, Scale 1" = 100', June 14, 1976, John J. Unwin, Reg. Land Surveyor, 30 North Street, Pittsfield, Mass." and recorded with the Berkshire Northern District Registry of Deeds as Plan No. 143, in Drawer 8. The above: described lot is subject to the following restrictions: 1. The lot shall only be used for residential purposes and no commercial or business use shall be made thereof. 2. No structure or building shall be erected or maintained on any lot other than a single family dwelling which may have an attached or detached garage and such other outbuildings and structures as are customarily appurtenant to single family dwellings. 3. Each dwelling unit erected on any lot shall have a total interior floor area of at least one thousand four hundred (1,400) square feet for a ranch style or raised ranch style home and at least two thousand (2,000) square feet for a colonial style or cape style home. 4. No trailer or other temporary structure shall be stored or placed on any lot except during periods of 'construction, and then only for a period not in excess of one hundred eighty (180) days. No trailer on any lot shall be occupied as a dwelling. 5. No animals other than usual household pets shall be kept on any lot. 6. All dwellings erected on any lot shall have a full basement or cellar. 7. All buildings constructed on any lot shall have a roof pitched in not less than (2) directions, said pitch shall not be less than 5" to 12". 8. The Hutchinson Realty Trust reserves the right to approve all building plans for any structure to be erected on any lot, and such approval shall not be unreasonably withheld. 9. The above described shall be graded, loamed and seeded within (1) year after the commencement of any construction. The Hutchinson Realty Trust reserves the right to inspect all connections to the water mains. Reserving out of this conveyance whatever rights, if any, the Berkshire Glass Sand Co., its successors or assigns may have in and to sand stone and any other minerals on any of the premises as described in a deed of Barnet Mason to Elisha Prince, dated February 28, 1968 and recorded in the Berkshire Northern District Registry of Deeds in Book 111, Page 435. Subject to the right, if any, to mine sand in any portion of the aforesaid premises conveyed to Elisha Prince b deed of Edna Ingalls, et al, dated April 1, 1912, and recorded in the aforementioned Registry of Deeds in Book 306, Page 253. Subject to an easement to New England Telephone and Telegraph Company and Massachusetts Electric Company, dated June 3, 1978, and recorded June 8, 1978 in the aforementioned Registry of Deeds in Book 684, Page 748. Being the same premises conveyed to the mortgagors herein by deed of Donald E. Bradley, Jr., dated March 30, 2018 and recorded in the Berkshire Northern District Registry of Deeds simultaneously herewith. The description of the property that appears in the mortgage to be foreclosed shall control in the event of a typographical error in this publication. For Mortgagors' Title see deed dated March 30, 2018, and recorded in Book 1650 at Page 711 with the Berkshire County (Northern District) Registry of Deeds. TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. Other terms to be announced at the sale.
