Peralta to Greylock Federal Credit Union, dated May 28, 2003 and recorded in Berkshire County (Middle District) Registry of Deeds in Book 2573, Page 148 (the "Mortgage") of which mortgage Ajax Mortgage Loan Trust 2021-B, By U.S. Bank National Association, As Indenture Trustee is the present holder by Assignment from Greylock Federal Credit Union to AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB Trustee dated November 23, 2016 and recorded at said Registry of Deeds in Book 5887, Page 341, and Assignment from AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB, Trustee to U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to AJAX Mortgage Loan Trust 2017-A, Mortgage-Backed notes, Series 2017-A dated June 6, 2017 and recorded at said Registry of Deeds in Book 5986, Page 50, and Assignment from U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to AJAX Mortgage Loan Trust 2017-A, Mortgage-Backed notes, Series 2017-A to AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB, Trustee dated January 6, 2020 and recorded at said Registry of Deeds in Book 6560, Page 227, and Assignment from AJX Mortgage Trust I, a Delaware Trust, Wilmington Savings Fund Society, FSB, Trustee to Ajax Mortgage Loan Trust 2021-B, by U.S. Bank National Association, as Indenture Trustee dated May 18, 2021 and recorded at said Registry of Deeds in Book 6969, Page 26, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 29 Waverly Street, Pittsfield, MA 01201 will be sold at a Public Auction at 12:00 PM on December 12, 2022, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: A certain parcel of land with all buildings and structures now or hereafter standing or placed thereon situated in Pittsfield in the County of Berkshire in the Commonwealth of Massachusetts bounded and described as follows: Two certain building lots being No. 11 and No. 13 as shown on a plan of Waverly Street Lots, dated July 1912 and recorded in Berkshire Middle District Registry of Deeds in Book 355, Page 623, to which plan reference may be had for a more particular description of said lots. Said lots are 62 feet wide and 114 deep each and being located on the east side of Waverly Street. Meaning and intending to convey and hereby conveying the same premises conveyed to the mortgagor herein by deed of Ernest J. Lunghi and Diane M. Lunghi to be recorded in the said Registry of Deeds simultaneously herewith. For mortgagor's title see deed recorded with the Berkshire County (Middle District) Registry of Deeds in Book 2573, Page 145. The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession. Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
