LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Catherine S. Lucier to Mortgage Electronic Registration Systems, Inc., as mortgagee, acting solely as a nominee for Fairway Independent Mortgage Corporation, dated February 25, 2008 and recorded in Berkshire County (Middle District) Registry of Deeds in Book 3997, Page 236 (the "Mortgage") of which mortgage US Bank Trust National Association, Not In Its Individual Capacity But Solely As Owner Trustee For VRMTG Asset Trust is the present holder by Assignment from Mortgage Electronic Registration Systems, Inc., as nominee for Fairway Independent Mortgage Corporation, its successors and assigns to GMAC Mortgage, LLC dated January 21, 2013 and recorded at said Registry of Deeds in Book 5128, Page 101, and Assignment from GMAC Mortgage, LLC to Ocwen Loan Servicing, LLC dated April 23, 2013 and recorded at said Registry of Deeds in Book 5181, Page 158, and Assignment from Ocwen Loan Servicing, LLC to Federal National Mortgage Association dated May 4, 2015 and recorded at said Registry of Deeds in Book 5549, Page 252, and Assignment from Federal National Mortgage Association to Nationstar Mortgage LLC d/b/a Mr. Cooper dated February 4, 2020 and recorded at said Registry of Deeds in Book 6577, Page 39, and Assignment from Nationstar Mortgage LLC d/b/a Mr. Cooper to US Bank Trust National Association, Not In Its Individual Capacity But Solely As Owner Trustee For VRMTG Asset Trust dated November 18, 2021 and recorded at said Registry of Deeds in Book 7079, Page 164, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 187 Lakeway Drive, Pittsfield, MA 01201 will be sold at a Public Auction at 2:00 PM on September 15, 2022, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: Being Lot No. 4 on plan entitled "Plan of Subdivision of 'Booth Land', Pittsfield, Mass. compiled from Records and Assessors data by Barnes & Race Engineers, Pittsfield, Mass. Scale 4 rods to an inch" on file in Berkshire Middle District Registry of Deeds in Drawer 54 file for record February 6, 1924. According to said plan, said lot has a frontage of seven (7) rods on the southerly side of Lakeway Drive, formerly Lake Avenue, and a depth of eight (8) rods on the westerly line of Miller Street. Being also Lot No. 4 on City of Pittsfield Assessors Map No. 173 formerly in use. Being the same premises conveyed to mortgagor herein by deed of Warren M. Lucier, Jr. and Catherine S. Lucier, dated February 25, 2008 and recorded February 29, 2008 in the Berkshire Middle District Registry of Deeds in Book 3997, Page 233. For mortgagor's title see deed recorded with the Berkshire County (Middle District) Registry of Deeds in Book 3997, Page 233; and Book 3997, Page 252. The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession. Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
