LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Lillian R. Martin to MetLife Home Loans, a Division of MetLife Bank, N.A., dated December 5, 2008 and recorded in Berkshire County (Middle District) Registry of Deeds in Book 4194, Page 60 (the "Mortgage") of which mortgage Wilmington Savings Fund Society, FSB, not in its individual capacity but solely in its capacity as Owner Trustee for Cascade Funding Mortgage Trust HB4 is the present holder by Assignment from MetLife Home Loans, a Division of MetLife Bank, N.A. to Nationstar Mortgage LLC dated September 4, 2012 and recorded at said Registry of Deeds in Book 5044, Page 10, and Assignment from Nationstar Mortgage LLC to Mortgage Assets Management, LLC dated February 9, 2022 and recorded at said Registry of Deeds in Book 7124, Page 13, and Assignment from Mortgage Assets Management, LLC f/k/a Reverse Mortgage Solutions, Inc. to Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as Owner Trustee for Cascade Funding Mortgage Trust HB4 dated October 10, 2023 and recorded at said Registry of Deeds in Book 7521, Page 270, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 127 Housatonic Street, Lenox, MA 01240 will be sold at a Public Auction at 11:00 AM on May 16, 2024, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: Beginning at a point in the Northerly line of Housatonic Street, which point is determined by starting from the Southwesterly corner of land of Ellen Johnson and running North 84 1/2 West sixty-six feet to where said point is; thence North 84 1/2 West, thirty-four feet and four inches to an angle marked by an iron pipe driven into the ground; thence North 82 50' West thirty-one feet and eight inches to the Easterly line of proposed street and to the Southwesterly corner of the premises being conveyed; thence North 5 45' East one hundred and sixty-five feet; thence South 84 15' East sixty-six feet; thence South 5 45' West one hundred and sixty-five feet to the said point at the place of beginning. Containing 10,890 feet of land more or less. For title see Deed at Book 1192, Page 819. For mortgagor's title see deed recorded with the Berkshire County (Middle District) Registry of Deeds in Book 1192, Page 819. The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession. Terms of the Sale: Cashier's or certified check in the sum of $5,000.00 as a deposit must be shown at the time and place of the sale in order to qualify as a bidder (the mortgage holder and its designee(s) are exempt from this requirement); high bidder to sign written Memorandum of Sale upon acceptance of bid; balance of purchase price payable by certified check in thirty (30) days from the date of the sale at the offices of mortgagee's attorney, Korde & Associates, P.C., 900 Chelmsford Street, Suite 3102, Lowell, MA or such other time as may be designated by mortgagee.
