NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE PRIVATE Premises: 252 Wahconah Street, Pittsfield, Massachusetts By virtue and in execution of the Power of Sale contained in a certain mortgage given by Shawn W. Bertulli to Mortgage Electronic Registration Systems, Inc., as nominee for United Wholesale Mortgage, its successors, said mortgage dated April 19, 2018, and recorded in the Berkshire County (Middle District) Registry of Deeds, in Book 6175 at Page 224 and now held by Lakeview Loan Servicing, LLC, for breach of the conditions in said mortgage and for the purpose of foreclosing the same, will be sold at Public Auction on August 26, 2022 at 11:00 AM Local Time upon the premises, subject to all encumbrances and prior liens, including the senior lien recorded on July 29, 2019 in Book 06445, Page 296 of the Berkshire County (Middle District) Registry of Deeds, all and singular the premises described in said mortgage, to wit: Closing Date: April 19, 2018 Borrower(s): Shawn W. Bertulli Property Address: 252 Wahconah Street, Pittsfield, MA 01201 The land and buildings thereon situated in the City of Pittsfield, Berkshire County, Commonwealth of Massachusetts, as follows: Beginning in the easterly line of Wahconah Street as defined by the easterly edge of the new concrete sidewalk recently constructed by the said City at a point marking the southwesterly corner of the property herein described and the northwesterly corner of property conveyed by Peter Burns to Kathryn Hynes, said point being marked by an iron pipe now found to be under said concrete sidewalk; running thence northerly in the easterly line of Wahconah Street thirty and twenty-five hundredths (30.25) feet to an iron pipe; thence deflecting to the right eighty-nine (89) degrees forty (40) minutes, running easterly along land of one Garrigan about two hundred twenty-three (223) feet to the highwater mark of the westerly branch of the Housatonic River, the last mentioned course being parallel to and six and seventy-five one-hundredths (6.75) feet from the foundation wall on the north side of the house herein described and is further marked by an iron pipe of said River about two (2) feet westerly of the highwater mark on the bank; thence southerly along the highwater mark of said River about fifty (50) feet to the northeast corner of the property of said Hynes; thence westerly along the northerly line of property of said Hynes about two hundred fifty-nine (259) feet to the place of beginning. Subject to and together with a right of way as set forth in an agreement between John F. Garrigan and Morris and Anne Teitlebaum, dated January 31, 1925 and recorded in the Berkshire Middle District Registry of Deeds in Book 419, Page 295. For title reference see deed recorded with the Berkshire Middle District Registry of Deeds HEREWITH. The description of the property that appears in the mortgage to be foreclosed shall control in the event of a typographical error in this publication. TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described.
