NOTICE OF MORTGAGEE'S SALE OF REAL ESTATE PRIVATE Premises: 28 Franklin Street, Dalton, Massachusetts By virtue and in execution of the Power of Sale contained in a certain mortgage given by Tammy L. Szklasz, Michael J. Szklasz and Edward H. Szklasz to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Merrimack Mortgage Company, Inc., said mortgage dated July 20, 2010, and recorded in the Berkshire County (Middle District) Registry of Deeds, in Book 4578 at Page 14 and now held by U.S. Bank National Association by virtue of an assignment from Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Merrimack Mortgage Company, Inc. to U.S. Bank National Association dated November 18, 2016 and recorded in Berkshire County (Middle District) Registry of Deeds in Book 5861, Page 206 for breach of the conditions in said mortgage and for the purpose of foreclosing the same, will be sold at Public Auction on August 17, 2022 at 11:00 AM Local Time upon the premises, all and singular the premises described in said mortgage, to wit: Parcel 1: That certain piece or parcel of land shown and designated as Lot No. 11 on Plan of Lots of E. M. Carty and G. H. Schnopp in Dalton, Mass., which plan is dated August, 1929, and drawn by W. O. Pease, Surveyor, and a copy of which Plan is on file in the Berkshire Middle District Registry of Deeds in Pittsfield, Massachusetts, in Drawer No. 114. And to which Plan reference is to be had. Said lot is situated on the southerly side of Franklin Street (formerly called Charles Street, and designated on said Plan as Charles Street); is bounded northerly by said Franklin Street, 64 feet; easterly by Lot No. 10 on said Plan, 109.58 feet; southerly by land now or formerly of one Fuller, 65.49 feet; and westerly by Lot No. 12 on said Plan, 123.48. Parcel II: Beginning at a point in the southerly line of Franklin Street making the northeasterly corner of lot No. twelve (12) as shown on REVISED PLAN of Lots E(dward) M. Carty and G(eorge) H. Schnopp, Revision on June 23, 1930, drawn by W. O. Pease, Surveyor, a copy of which plan is field with the Berkshire Middle District Registry of Deeds at Pittsfield, Massachusetts, in DRAWER 14, HIGH DESK, which point is also the northwesterly corner of lot No. eleven (11) as shown on said plan (said lot 11 now owned by Arthur L. Packard and Annie L. Packard); thence running in a westerly direction and along the northerly lien of said lot No. twelve (12) a distance of thirty-two (32) feet to a point; running thence in a southerly direction and in a line parallel to and 32 feet westerly from the easterly line of said lot 12 as shown on said plan a distance of about one hundred thirty and 43/100 (130.43) feet to a point in the southerly line of lot No. twelve (12) a distance of about thirty-two and 745/1000 (32.745) feet to the southeasterly corner of said lot No. twelve (12); running thence in a northerly direction and along the said easterly line of lot No. twelve (12) a distance of one hundred twenty-three and 48/100 (123.48) feet to the point of beginning. Being the easterly one-half of said lot No. twelve (12) and which is adjoined by said lot No. eleven (11) on the east. Being the same premises conveyed to the mortgagors herein by deed of the Merriam Nominee Real Estate Trust, to be recorded simultaneously herewith. The description of the property that appears in the mortgage to be foreclosed shall control in the event of a typographical error in this publication. For Mortgagors' Title see deed dated July 16, 2010, and recorded in Book 4578 at Page 11 with the Berkshire County (Middle District) Registry of Deeds. TERMS OF SALE: Said premises will be sold and conveyed subject to all liens, encumbrances, unpaid taxes, tax titles, municipal liens and assessments, if any, which take precedence over the said mortgage above described. FIVE THOUSAND ($5,000.00) Dollars of the purchase price must be paid by a certified check, bank treasurer's or cashier's check at the time and place of the sale by the purchaser. The balance of the purchase price shall be paid in cash, certified check, bank treasurer's or cashier's check within sixty (60) days after the date of sale. Other terms to be announced at the sale.
