LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Robert E. Jones and Michelle R. Jones to Beneficial Massachusetts Inc., dated March 18, 2004 and recorded in Berkshire County (Northern District) Registry of Deeds in Book 1150, Page 783 (the "Mortgage") of which mortgage Ajax Mortgage Loan Trust 2021-C, Mortgage-Backed Securities, Series 2021-C, by U.S. Bank National Association, as Indenture Trustee is the present holder by Assignment from Beneficial Massachusetts Inc. to DLJ Mortgage Capital, Inc. dated June 28, 2018 and recorded at said Registry of Deeds in Book 1669, Page 946, and Assignment from DLJ Mortgage Capital, Inc. to U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to Ajax Mortgage Loan Trust 2018-A Mortgage-Backed Notes dated July 10, 2018 and recorded at said Registry of Deeds in Book 1669, Page 949, and Assignment from U.S. Bank National Association, as Indenture Trustee on behalf of and with respect to Ajax Mortgage Loan Trust 2018-A Mortgage-Backed Notes to AJAX Mortgage Loan Trust 2021-C, Mortgage Backed Securities, Series 2021-C, by U.S. Bank National Association, as Indenture Trustee dated June 7, 2021 and recorded at said Registry of Deeds in Book 1755, Page 1016, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 16 East Main Street, Cheshire, MA 01225 will be sold at a Public Auction at 12:00 PM on June 24, 2022, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: SITUATED IN BERKSHIRE COUNTY, MASSACHUSETTS, TO WIT: BEGINNING AT AN OLD SPIKE ON THE SOUTHERLY SIDE OF WINDSOR ROAD, WHICH POINT OF BEGINNING IS ALSO AT THE NORTHWESTERLY CORNER OF FURNACE ROAD WHERE THE SAME INTERSECTS WITH WINDSOR ROAD; THENCE IN A WESTERLY DIRECTION ALONG THE SOUTHERLY SIDE OF SAID WINDSOR ROAD 167 FEET, MORE OR LESS, TO AN IRON PIN SET IN THE GROUND; THENCE TURNING TO THE LEFT AND RUNNING SOUTH 28 DEG. 44' WEST 152.9 FEET TO AN IRON PIN SET IN THE GROUND; THENCE TURNING TO THE LEFT AND RUNNING SOUTH 67 DEG. 68' EAST 98.2 FEET ALONG THE NORTHERLY LINE OF LAND NOW OR FORMERLY OF KENNETH E. HERZIG ET UX TO AN IRON PIN DRIVEN IN THE GROUND; THENCE TURNING TO THE LEFT AND RUNNING NORTH 47 DEG. 51' EAST 163.6 FEET ALONG THE WESTERLY LINE OF SAID FURNACE ROAD TO THE POINT AND PLACE OF BEGINNING BEING THE SAME PROPERTY CONVEYED FROM LAWRENCE C. HERZIG AND THOMAS L. HERZIG, EXECUTORS OF THE WILL OF EVELYN MAE HERZIG AKA EVELYN M. HERZIG, DECEASED, TO ROBERT E. JONES AND MICHELLE R. JONES, HUSBAND AND WIFE, BY DEED RECORDED 12/18/87, IN BOOK 782, AT PAGE 935, IN THE REGISTER'S OFFICE OF BERKSHIRE COUNTY, MASSACHUSETTS. For mortgagor's title see deed recorded with the Berkshire County (Northern District) Registry of Deeds in Book 782, Page 935. The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
