COMMONWEALTH OF MASSACHUSETTS The Trial Court Probate and Family Court Department Berkshire Division Docket No. BE24E0012 TO: Steven S. Nikitas of Pittsfield, Massachusetts and all other persons interested; A Petition for Partition, dated March 4, 2024 and presented to said Court by Tatiana Saunders of Sheffield, Massachusetts, representing that she holds as tenant in common an undivided part or share in certain real estate situate in Pittsfield, Berkshire County, Massachusetts, and described as follows: Being Lot 8 as shown on Plan of Lots of Stonehenge Road, known as Section 2, which Plan is dated August, 1963 and is recorded in the Berkshire Middle District Registry of Deeds in Bok 417-E, Page 207A. Subject to the restriction that no animals, cattle or poultry of any description, other than a household pet shall be kept on said premises. Being the same premises conveyed to Calleen S. Nikitas by deed of S. Peter Nikitas and Calleen S. Nikitas dated October 28, 1998 and recorded on November 9, 1998 in the Berkshire Middle District Registry of Deeds in Book 1630, Page 660. Note: Calleen S. Nikitas a/k/a Calleen Deena Nikitas died on May 17, 2008. See her death certificate recorded in said Registry in Book 4128, Page 211. Also, see related Estate Tax Affidavit recorded in said Registry in Book 4238, Page 338. For title, see Berkshire Probate and Family Court Docket No. BE08P0398. The common title to said land is derived under the will of Calleen S. Nikitas. Calleen S. Nikitas devised the residue of her estate, which included the Premises, to the petitioner's decedents, and to their brother, Steven Nikitas, pursuant to Article 1A of said Will. And, if the Court finds that said land cannot be advantageously divided, the petitioner desires that all of said land may be sold at private or public sale for not less than $405,600.00 and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition of all, or any part of said land which the Court finds cannot be advantageously divided at public or private sale; and be ordered to distribute the net proceeds thereof in such manner as to make the partition just and equal. If you desire to object thereto, you or your attorney should file a written appearance in said Court at 44 Bank Row, Pittsfield, MA 01201, before ten o'clock in the forenoon on the 3rd day of June, 2024, the return day of this citation.
