LEGAL NOTICE MORTGAGEE'S SALE OF REAL ESTATE By virtue of and in execution of the Power of Sale contained in a certain mortgage given by Orit Kadosh and Joshua Nunberg to Bank of America, N.A., dated February 5, 2007 and recorded in Berkshire County (Southern District) Registry of Deeds in Book 1763, Page 160 (the "Mortgage") of which mortgage U.S. Bank, National Association, as Trustee, for the Certificateholders of Banc of America Funding Corporation Mortgage Pass-Through Certificates, Series 2007-B is the present holder by Assignment from Bank of America, N.A. to U.S. Bank, National Association, as Trustee, for the Certificateholders of Banc of America Funding Corporation Mortgage Pass-Through Certificates, Series 2007-B dated April 3, 2014 and recorded at said Registry of Deeds in Book 2247, Page 52, for breach of conditions of said mortgage and for the purpose of foreclosing the same, the mortgaged premises located at 678 Stockbridge Road, Great Barrington, MA 01230 will be sold at a Public Auction at 11:00 AM on October 29, 2021, at the mortgaged premises, more particularly described below, all and singular the premises described in said mortgage, to wit: The following described real property situate in the city of Great Barrington, County of Berkshire, and Commonwealth of Massachusetts, to wit: Beginning at an iron pipe set or to be set in the easterly sideline of Stockbridge road, said point being the northwesterly corner of the premises hereby conveyed and also being the southwesterly corner of land, now or formerly, of Dennis L. Mareb and Judith L. Mareb, a.k.a Windy Hill Farm; Running thence the following courses and distances in the line of land of Mareb: South 87 degrees 59 minutes 44 seconds east a distance of 1783.50 feet to an iron pipe found; South 17 degrees 03 minutes 13 seconds west a distance of 184.28 feet to an iron pipe set or to be set; South 02 degrees 48 minutes 13 seconds west a distance of 185.28 feet to an iron pipe found; and South 87 degrees 50 minutes 51 seconds east a distance of 1,073.50 feet to a point in the center line of Konkapot Brook, said point being the northeasterly corner of the premises hereby conveyed; Running thence generally southerly along the center line of Konkapot Brook to a point that is south 00 degrees 34 minutes 38 seconds east a distance of 370.95 feet from the previous point, the last noted point being the southeasterly corner of the premises hereby conveyed and also being the northeasterly corner of other land of the grantor; Running thence north 82 degrees 05 minutes 31 seconds west a distance of 2,951.97 feet to an iron pipe set or to be set in the easterly sideline of Stockbridge Road, said point being the southwesterly corner of the premises hereby conveyed; Running thence north 16 degrees 35 minutes 13 seconds east a distance of 450 feet along the easterly sideline of Stockbridge Road to the iron pipe set or to be set to the place of beginning. Containing 30.0 acres, more or less. Tax ID #: 39-3A By fee simple deed from Orit Kadosh to Orit Kadosh and Joshua Nunberg as set forth in Deed Book 1763, Page 157, dated 02-05-07 and recorded on 4-17-07, Berkshire County records. The source deed as stated above is the last record of vesting filed for this property. There have been no vesting changes since the date of the above referenced source. For mortgagor's title see deed recorded with the Berkshire County (Southern District) Registry of Deeds in Book 1763, Page 157. The premises will be sold subject to any and all unpaid taxes and other municipal assessments and liens, and subject to prior liens or other enforceable encumbrances of record entitled to precedence over this mortgage, and subject to and with the benefit of all easements, restrictions, reservations and conditions of record and subject to all tenancies and/or rights of parties in possession.
